ORDER OF THE PRESIDENT
OF THE FOURTH CHAMBER OF THE GENERAL COURT

European Commission, represented by S. Lejeune, S. Delaude and F. Moro, acting as Agents, and by P. Wytinck and B. Hoorelbeke, lawyers,

defendant,

APPLICATION, first, for annulment of the decision of the Commission, notified on 19 April 2013, to reject the tender submitted by the applicant in the context of the restricted call for tenders DIGIT/R2/PR/2011/039 relating to ‘Trans European Services for Telematics between Administrations — new generation (TESTA-ng)’ and to award the contract to another tenderer, and, secondly, for damages.


1        By letter lodged at the Court Registry on 26 November 2015, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings and that the question of costs had been the subject of an agreement between the parties, according to which each party bears its own costs.

2        By letter lodged at the Court Registry on 27 November 2015, the defendant informed the Court that it agreed with the discontinuance, and confirmed that the parties agreed that each party bears its own costs.

3        Article 136(3) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs is to be in accordance with that agreement.

4        The case shall therefore be removed from the register and the order for costs shall be as agreed between the parties.

On those grounds,

THE PRESIDENT OF THE FOURTH CHAMBER OF THE GENERAL COURT

hereby orders:

1)      Case T-335/13 is removed from the register of the General Court.

2)      The parties shall bear their own costs.
