The applicant claims that the Court should:

annul (i) the applicant’s 2021 professional performance document issued on 29 March 2022 (the first disputed decision); (ii) the applicant’s 2021 professional performance document newly issued on 15 March 2023 upholding the first disputed decision (the second disputed decision); (iii) the decision communicated on 22 March 2023 not to award the applicant an appropriate increase of salary in 2022, as per the average applied by the defendant, with the allocation of a performance award to the applicant for 2021 and with a promotion (the third disputed decision); and (iv) the defendant’s decision dated 21 November 2023 to reject the applicant’s administrative review request of 21 May 2023, disputing the legality of the above-listed three disputed decisions ;

order compensation for the moral damage suffered by the applicant amounting to EUR 30 000, to be assessed ex aequo et bono;

order compensation for the material financial damage suffered by applicant amounting to EUR 50 000, provisionally calculated amount;

order compensation for the legal fees for the current proceedings amounting to EUR 35 000 (including VAT).

Pleas in law and main arguments

In support of the action, the applicant relies on two pleas in law.

First plea in law, alleging the illegality of the disputed decisions following the defendant’s wrongful actions and/or omissions in breach of the applicant’s fundamental rights of equal treatment and non-discrimination, of good administration and respect by defendant of its duty to care towards the applicant.

Second plea in law, alleging liability of the defendant for material and moral damages suffered by the applicant as a result of the illegality of the disputed decisions and related violations of the applicant’s fundamental rights.
