ORDER OF THE PRESIDENT OF THE COURT

APPEALS under Article 56 of the Statute of the Court of Justice, lodged on 18 and 20 March 2009,

THE PRESIDENT OF THE COURT,

after hearing the views of Advocate General Mengozzi,

makes the following

Order

1        By application lodged at the Registry of the Court on 31 July 2009 (fax of 30 July), Ireland, represented by D. O’Hagan, acting as Agent, with an address for service in Luxembourg, sought leave to intervene in Joined Cases C-106/09 P and C‑107/09 P in support of the forms of order sought by the United Kingdom of Great Britain and Northern Ireland and by the Government of Gibraltar.

2        The application to intervene was made in accordance with Articles 93(1) and 123 of the Rules of Procedure, and is made pursuant to the first paragraph of Article 40 of the Statute of the Court of Justice.

On those grounds, the President of the Court hereby orders:

1.      Ireland is granted leave to intervene in Joined Cases C‑106/09 P and C‑107/09 P in support of the forms of order sought by the United Kingdom of Great Britain and Northern Ireland and by the Government of Gibraltar.

2.      A period shall be prescribed within which the intervener must set out in writing the pleas relied on in support of the form of order which it seeks.

3.      The Registrar shall arrange for a copy of every document in the case to be served on the intervener.

The costs are reserved.
