The applicant claims that the Court should:

Declare that, (i) by having failed to review and update the river basin management plans and to send a copy of the updates to the Commission and (ii) by having failed to review and, where applicable, update the flood risk management plans and to make the reviewed and potentially updated version thereof available to the Commission, the Hellenic Republic has failed to fulfil its obligations under Article 13(7) and Article 15(1) of Directive 2000/60/EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy 1 and under Article 14(3) and Article 15(1) of Directive 2007/60/EC of the European Parliament and of the Council on the assessment and management of flood risks; 2

Order the Hellenic Republic to pay the costs.

Pleas in law and main arguments

The European Commission submits that the Hellenic Republic has failed to review and update the river basin management plans and failed to send a copy of the updates to the Commission within the prescribed period.

In addition, the European Commission submits that the Hellenic Republic has failed to review and, where applicable, update the flood risk management plans within the prescribed period and failed to make the reviewed and potentially updated version of the flood risk management plans available to the Commission within the prescribed period.

On those grounds, the European Commission claims that the Hellenic Republic has infringed Article 13(7) and Article 15(1) of Directive 2000/60/EC and Article 14(3) and Article 15(1) of Directive 2007/60/EC.
