1. Annuls the decision of the First Board of Appeal of Board of Appeal of the Office for the Harmonisation of the Internal Market (Trade Marks and Designs) (OHIM) of 20 May 2010 (Case R 988/2009‑1);

2. Orders each party to bear its own costs.
