By its action under Article 263 TFEU, the applicant seeks the annulment of the decision of the Second Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 19 January 2023 (Case R 982/2022-2).

The Court:

1.    Dismisses the action;

2.    Orders Drinks Prod SRL to bear its own costs and to pay those incurred by Mr Siegfried Wolff and Mr Matthias Illg.
