APPLICATION pursuant to Article 263(4) of the Treaty on the Functioning of the European Union (‘TFEU’) for the annulment of Commission Delegated Regulation (EU) 2019/2015 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of light sources and repealing Commission Delegated Regulation (EU) No 874/2012 (OJ 2019, L 315, p. 68).
1 By letter lodged at the Court Registry on 18 March 2021, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings and that the question of costs had been the subject of an agreement between the parties, according to which each party will bear its own costs.
2 By letter lodged at the Court Registry on 26 March 2021, the defendant informed the Court that it agrees with the discontinuation of the proceedings and removal of the case from the register and that it agrees with the proposal that each party should be ordered to bear its own costs.
3 Article 136(3) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs is to be in accordance with that agreement.
4 The case shall therefore be removed from the register and the order for costs shall be as agreed between the parties.
On those grounds,
THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT
hereby orders:
1. Case T-140/20 is removed from the register of the General Court.
2. Each party shall bear its own costs.
