Operative part of the order

1.    The appeal is dismissed in part as manifestly inadmissible and in part as manifestly unfounded.

2.    Mr Luigi Marcuccio is ordered, in addition to bearing his own costs, to pay the costs incurred by the European Commission in the appeal.
