ORDER OF THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

In Case T-35/12,

Icelandic Group UK Ltd, established in Grimsby (United Kingdom), represented by V. Sloane, Barrister,

applicant,

v

European Commission, represented by L. Keppenne and A. Sauka, acting as Agents, assisted by F. Tuytschaever, lawyer,

defendant,

ANNULMENT of Commission Decision C (2011) 8113 final of 15 November 2011 finding that repayment of a certain amount of import duties is justified, but that the reimbursement of the import duties for another amount is not justified in a particular case concerning importations of frozen fish filets processed in China from Norwegian fish (REM 04/2010).


1        By letter lodged at the Registry of the General Court on 23 November 2012, the applicant informed the Court, in accordance with Article 99 of the Rules of Procedure, that it wished to discontinue proceedings and that the question of costs had been the subject of an agreement between the parties, according to which the defendant will bear both its own costs as well as the costs of the applicant.

2        By letter lodged at the Registry of the Court on 3 December 2012, the defendant informed the Court that it agrees to bear both its own costs as well as the costs of the applicant.

3        The second subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs shall be in accordance with that agreement.

4        The case will therefore be removed from the register and the order for costs shall be as agreed between the parties.

On those grounds,

THE PRESIDENT OF THE EIGHTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-35/12 is removed from the register of the General Court.

2.      The defendant shall bear its own costs as well as those incurred by the applicant.
