Annulment of Commission Decision C(2012) 3150 final of 11 May 2012 declaring the aid granted to ING by the Netherlands in the context of the restructuring plan compatible with the internal market, subject to compliance with certain conditions (State aid SA.28855 (N 373/2009) (ex C 10/2009 and ex N 528/2008) – The Netherlands/ING – restructuring aid).
1 By letters lodged at the Registry of the General Court on 19 November 2012, the applicants informed the Court, in accordance with Article 99 of the Rules of Procedure, that they wished to discontinue proceedings and requested that each party would bear its own costs.
2 By letter lodged at the Registry of the Court on 23 November 2012, the defendant informed the Court that it has no observations on the application for discontinuance.
3 The third subparagraph of Article 87(5) of the Rules of Procedure provides that, if costs are not applied for, the parties shall bear their own costs.
4 The cases will therefore be removed from the register and each party will bear its own costs.
On those grounds,
THE PRESIDENT OF THE FIRST CHAMBER OF THE GENERAL COURT
hereby orders:
1. Joined Cases T-325/12 and T-332/12 are removed from the register of the General Court.
2. Each party shall bear its own costs.
