APPLICATION for the suspension of the Commission’s decision of 26 January 2012 to send to the High Court of England and Wales, for the purposes of national proceedings, certain documents lodged with the Commission by the applicant and its subsidiaries in the context of competition proceedings relating to a cartel in the Gas Insulated Switch Gear sector (COMP/38.899 – Gas Insulated Switchgear (OJ 2008 C 5, p. 7)).


1        The applicant lodged an application for interim measures at the Registry of the General Court on 13 April 2012.

2        By a document lodged at the Registry of the General Court on 1 May 2012, National Grid Electricity Transmission plc sought leave to intervene in support of the defendant.

3        By letter lodged at the Registry of the General Court on 22 May 2012, the applicant informed the Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings. It requested that the defendant should bear the costs of the applicant or, in the alternative, that the defendant should be ordered to bear its own costs.

4        By letter lodged at the Registry of the Court on 29 May 2012, the defendant informed the Court that it had no objections to the application for discontinuance and requested that each party should be ordered to bear its own costs.

5        It is, therefore, appropriate to remove the application for interim measures from the register. As regards the costs, it is appropriate in the context of the procedure for interim measures that these should be reserved.

6        In these circumstances, there is no need to rule on the application for leave to intervene submitted by National Grid Electricity Transmission plc.


THE PRESIDENT OF THE GENERAL COURT

hereby orders:

1.      Case T-173/12 R is removed from the register of the General Court.

2.      The decision as to costs is reserved.

3.      There is no need to rule on the application for leave to intervene submitted by National Grid Electricity Transmission plc.
