defendant,

APPLICATION for partial annulment of Commission Decision C (2011) 9440 final of 22 December 2011 concerning an application for a refund of anti-dumping duties paid on imports of castings from the People’s Republic of China.


1        By letter lodged at the Registry of the General Court on 21 March 2012, the applicant informed the Court in accordance with Article 99 of the Rules of Procedure that it wished to discontinue proceedings. It sought no order as to costs.

2        By letter lodged at the Registry of the Court on 13 April 2012, the defendant informed the Court that it has no further observations to make on the application for discontinuance. The defendant requested that each party should bear its own costs.

3        The third subparagraph of Article 87(5) of the Rules of Procedure provides that if costs are not applied for, the parties shall bear their own costs. In the present case, the applicant sought no order as to costs, while the defendant requested that each party should bear its own costs.

4        The case will therefore be removed from the register and each party ordered to pay its own costs.

On those grounds,

THE PRESIDENT OF THE THIRD CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-112/12 is removed from the register of the General Court.

2.      Each party shall bear its own costs.
