ANNULMENT of Commission Decision C(2007)546 of 15 February 2007, adopted in the context of a proceeding pursuant to Article 81 EC (Case COMP/F/39309 – Thin Film Transistors Liquid Crystal Displays (TFT/LCD)), ordering the applicants to supply certain information pursuant to Article 18(3) of Council Regulation (EC) No 1/2003 of 16 December 2002 on the implementation of the rules on competition laid down in Articles 81 [EC] and 82 [EC] (OJ 2003 L 1, p. 1).
1 By letter lodged at the Registry of the General Court on 13 January 2011, the applicants informed the Court in accordance with Article 99 of the Rules of Procedure that they wished to discontinue proceedings.
2 By letter lodged at the Registry of the Court on 20 January 2011, the defendant informed the Court that it has no objections to discontinue proceedings. The defendant requested that the applicants should be ordered to bear the costs of the proceedings.
3 The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant applied for the costs to be borne by the applicants.
4 The case will therefore be removed from the register and the applicants ordered to pay the costs.
On those grounds,
THE PRESIDENT OF THE FIRST CHAMBER (EXTENDED COMPOSITION) OF THE GENERAL COURT
hereby orders:
1. Case T-140/07 is removed from the register of the General Court.
2. The applicants shall bear the costs.
