Can EU law, the principle of respect for, and protection of, the right to private property derived from Article 17 of the Charter [of Fundamental Rights of the European Union], the principle of the primacy of EU law over national law and, in particular, the first sentence of Article 9(6) of Directive (EU) 2019/1023 of the European Parliament and of the Council of 20 June 2019 on preventive restructuring frameworks, on discharge of debt and disqualifications, and on measures to increase the efficiency of procedures concerning restructuring, insolvency and discharge of debt, and amending Directive (EU) 2017/1132 (Directive on restructuring and insolvency), 1 be interpreted as precluding national legislation such as that at issue in the main proceedings (Article 139(1) [point] (C) of Law No 85/2014], which, in the context of insolvency proceedings, [allows] the reorganisation/restructuring plan to be deemed to have been accepted if, where there are two or four categories of claims, at least half the number of categories votes in favour of it, provided that one of the disadvantaged categories accepts the plan and at least 30% of the total, by value, of the general body of creditors accepts that same plan?
