In Case T-91/02, Klausner Nordic Timber GmbH & Co. KG, established in Wismar (Germany), represented by D. Reich, lawyer, with an address for service in Luxembourg, against the Commission of the European Communities (Agents: V. Kreuschitz and

V. Di Bucci) ( application for the annulment of Commission Decision 2002/468/EC, of 15 January 2002 on the State aid implemented by Germany for Klausner Nordic Timber GmbH & Co. KG, Wismar, Mecklenburg-Western Pomerania (OJ 2002 L 165, p. 15) ( the Court of First Instance (Fourth Chamber, Extended Composition), composed of V. Tiili, President, J. Pirrung, P. Mengozzi, A. W. H. Meij and M. Vilaras, Judges; H. Jung, Registrar, made an order on 8 April 2003, the operative part of which is as follows:

1.There is no need to give a decision on the present action.

2.The Commission shall pay the costs, including those relating to the procedure for interim relief.
