Form of order sought

The appellant claims that the Court should:

set aside the order under appeal;

following the setting aside of the order under appeal, annul the decision at issue of the Council (EU) 2023/1335 of 27 June 2023 appointing the European Prosecutors of the European Public Prosecutor’s Office 1 in its entirety or, at the very least, in so far as it appoints the candidate proposed by Greece and rejects the appellant’s candidacy for the position of European Public Prosecutor; and

order the other parties to bear their own costs and to pay those incurred by the appellant in the present proceedings.

Grounds of appeal and main arguments

In support of his appeal, the appellant raises two grounds.

In the first place, he submits that the General Court made an error of assessment in ruling that it lacked jurisdiction.

In the second place, he submits that the General Court made an error of assessment in holding that the appellant did not have an interest in bringing proceedings.
