ORDER OF THE PRESIDENT
OF THE THIRD CHAMBER OF THE GENERAL COURT

In Case T‑391/20,

Stena Line Scandinavia AB, established in Gothenburg (Sweden), represented by L. Sandberg-Mørch, lawyer,

European Commission, represented by G. Braga da Cruz and S. Noë, acting as Agents,

defendant,

APPLICATION pursuant to Article 263 TFEU seeking the annulment of the Commission Decision C(2020) 1683 final of 20 March 2020 on the State aid SA.39078-2019/C (ex 2014/N) which the Kingdom of Denmark implemented for Femern A/S for the Fehmarn Belt fixed rail-road link between Denmark and Germany (OJ 2020 L 339, p. 1).


1        By letter lodged at the Court Registry on 9 September 2021, the applicant informed the Court, in accordance with Article 125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings. It sought no order as to costs.

2        By letter lodged at the Court Registry on 14 September 2021, the defendant informed the Court that it had no observations on the request to discontinue proceedings and requested that the applicant be ordered to pay the costs.

3        Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

4        As the proceedings in the main case have been discontinued before the applications to intervene by the Kingdom of Denmark, Föreningen för Svensk Sjöfart, Trelleborg Hamn AB, European Community Shipowners’ Associations and Rederi Aktiebolaget Nordö-Link have been decided, there is no need to rule on these applications to intervene.

5        The case shall therefore be removed from the register and the applicant ordered to pay the costs, with the exception of those relating to the applications to intervene.

6        Pursuant to Article 144(10) of the Rules of Procedure, the applicant, the defendant, the Kingdom of Denmark, Föreningen för Svensk Sjöfart, Trelleborg Hamn, European Community Shipowners’ Associations and Rederi Aktiebolaget Nordö-Link are each to bear their own costs relating to the applications to intervene.

On those grounds,

THE PRESIDENT OF THE THIRD CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T391/20 is removed from the register of the General Court.

2.      There is no need to rule on the applications to intervene submitted by the Kingdom of Denmark, Föreningen för Svensk Sjöfart, Trelleborg Hamn AB, European Community Shipowners’ Associations and Rederi Aktiebolaget Nordö-Link.

3.      Stena Line Scandinavia AB shall bear its own costs and shall pay those incurred by the European Commission, with the exception of those relating to the applications to intervene.

4.      Stena Line Scandinavia, the Commission, the Kingdom of Denmark, Föreningen för Svensk Sjöfart, Trelleborg Hamn, European Community Shipowners’ Associations and Rederi Aktiebolaget Nordö-Link shall each bear their own costs relating to the applications to intervene.
