ORDER OF THE PRESIDENT OF THE FOURTH CHAMBER OF THE GENERAL COURT

APPLICATION for annulment of the European Commission’s decision of 30 October 2013, communicated to applicants by letter dated 31 October 2013, rejecting the OPTIMUS consortium’s bid for tender DIGIT/R2/PO/2012/026 – ITIC-SM (IT service management for the integrated and consolidated IT desktop environment of the European Commission) (OJ 2012/S 69-112095) and awarding the contract to the GISIS consortium.


1        The applicants brought the present action by application lodged at the Registry of the General Court on 4 December 2013. That case was registered as Case
T-644/13.

2        By separate document lodged at the Registry of the General Court on 4 December 2013, the applicants lodged an application for interim measures. That case was registered as Case T-644/13 R.

3        By order of 4 February 2014 the Judge hearing the application for interim measures dismissed the application for interim measures and the decision as to costs be reserved.

4        By letter lodged at the Registry of the General Court on 20 March 2014, the applicants informed the Court, in accordance with Article 99 of the Rules of Procedure, that they wished to discontinue proceedings.

5        By letter lodged at the Registry of the Court on 2 April 2014, the defendant informed the Court that the question of costs had been the subject of an agreement between the parties, according to which the applicants will bear the costs incurred by the Commission for the present (T-644/13) and related interlocutory
(T-644/13 R) proceedings.

6        The second subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and the parties have come to an agreement on costs, the order for costs shall be in accordance with that agreement.

7        The case will therefore be removed from the register and the order for costs shall be as agreed between the parties both for Case T-644/13 and Case T-644/13 R.

On those grounds,

THE PRESIDENT OF THE FOURTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-644/13 is removed from the register of the General Court.

2.      The applicants shall bear the costs in Case T-644/13 and Case 
T-644/13 R.
