1        The defendant has requested, pursuant to Article 116(2) of the Rules of Procedure, that certain confidential information be omitted from the documents provided to the intervener, the European Biodiesel Board, and has produced, for that purpose, a non-confidential version of the documents in question.

2        At this stage, the provision to the intervener, the European Biodiesel Board, of the procedural documents served or to be served on the parties will therefore be restricted to a non-confidential version. A decision as to whether the application for confidentiality is well founded shall, if necessary, be taken at a later stage in the light of any objections submitted on that issue.

On those grounds,

THE PRESIDENT OF THE NINTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      The Registrar shall provide the intervener, the European Biodiesel Board, with a non‑confidential version of each of the procedural documents served on the parties.

2.      A period shall be fixed for the intervener to submit objections regarding the application for confidential treatment. The decision on whether that application is well founded is reserved.

3.      The costs are reserved.
