APPLICATION for annulment of Commission Decision Ares (2012) 1271350 of 26 October 2012, dismissing as inadmissible the application for internal review of the Commission Implementing Regulation (EU) No 582/2012 of 2 July 2012 approving the active substance bifenthrin, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (OJ 2012 L 173, p. 3).


1        By letter lodged at the Registry of the General Court on 18 February 2015, the applicants informed the Court in accordance with Article 99 of the Rules of Procedure that they wished to discontinue proceedings. They sought no order as to costs.

2        By letter lodged at the Registry of the Court on 27 February 2015, the defendant requested, pursuant to Article 87(5) of the Rules of Procedure, that the applicants be ordered to pay the costs.

3        The first subparagraph of Article 87(5) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings shall be ordered to pay the costs if they have been applied for in the observations of the other party on the discontinuance. In the present case, the defendant requested that the applicants be ordered to pay the costs.

4        The case will therefore be removed from the register and the applicants ordered to pay the costs.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-8/13 is removed from the register of the General Court.

2.      The applicants shall bear the costs.
