The action is dismissed as being inadmissible.

The Federación Nacional de Empresarios de Minas de Carbón (Carbunión) shall, in addition to bearing its own costs, pay the costs incurred by the Council of the European Union, including those relating to the proceedings for interim measures.

3.    The European Commission shall bear its own costs.
