ORDER OF THE VICE-PRESIDENT OF THE COURT

In Case C‑136/23 P(I),

APPEAL under the first paragraph of Article 57 of the Statute of the Court of Justice of the European Union, brought on 4 March 2023,

EuroChem Group AG, established in Zug (Switzerland),

Siberian Coal Energy Company JSC (Suek), established in Moscow (Russia), represented by S. Bonifassi, avocat,

appellants,

the other parties to the proceedings being:

Andrey Melnichenko, residing in St. Moritz (Switzerland), represented by A. Miron and D. Müller, avocats,

applicant at first instance,

Council of the European Union, represented by B. Driessen and  S. Van Overmeire, acting as Agents,

defendant at first instance,

THE VICE-PRESIDENT OF THE COURT,

after hearing the Advocate General, M. Szpunar,

makes the following

Order

1        By document lodged via e-Curia on 5 May 2023, the appellants, EuroChem Group AG and Siberian Coal Energy Company JSC (Suek), informed the Court that they wished to discontinue their appeal, in accordance with Article 148 of the Rules of Procedure of the Court of Justice, applicable to appeals pursuant to Article 190(1) thereof.

2        By document lodged via e-Curia on 9 May 2023, Mr Andrey Melnichenko informed the Court that he did not intend to submit observations on the discontinuance.

3        By document lodged via e‑Curia on 11 May 2023, the Council informed the Court that it did not object to the discontinuance.

4        Pursuant to the combined provisions of Article 141(4) and Article 184(1) of the Rules of Procedure, if costs are not claimed, the parties are to bear their own costs.

5        In the circumstances of the present case, it is appropriate to order each party to bear its own costs.

On those grounds, the Vice-President of the Court hereby orders:

1.      Case C136/23 P(I) is removed from the Register of the Court.

2.      Each party shall bear its own costs.
