Judgment of the Court of First Instance of 13 June 2002 in Case T-74/01: Albano Ferrer de Moncada v Commission of the European Communities1

In Case T-74/01: Albano Ferrer de Moncada, an official of the Commission of the European Communities, residing in Luxembourg, represented by L. Misson and L. Wysen, avocats, with an address for service in Luxembourg, v Commission of the European Communities (Agents: C. Berardis-Kayser and D. Waelbroeck) ( application, first, for annulment of the Commission's decision of 19 January 2001 implicitly rejecting the complaint lodged by the applicant against the Commission's decision of 28 August 2000 refusing him leave to produce certain documents in proceedings before a Luxembourg criminal court and, second, for compensation ( the Court of First Instance (Third Chamber), composed of: M. Jaeger, President, and K. Lenaerts and J. Azizi, Judges; J. Plingers, Administrator, for the Registrar, has given a judgment on 13 June 2002, in which it:

1.Annuls the Commission's decision of 19 January 2001 implicitly rejecting the complaint lodged by the applicant against the Commission's decision of 28 August 2000 refusing him leave to produce the documents referred to in that complaint in proceedings before a Luxembourg criminal court;

2.Dismisses the remainder of the action;

3.Orders the Commission to bear its own costs and to pay those of the applicant.
