Re:

By its action based on Article 263 TFEU, the applicant seeks, in essence, annulment of the decision of the Third Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 7 December 2022 (Case R 1604/2021-3).

Operative part of the judgment

The Court:

1.    Dismisses the action;

2.    Orders Nextrend GmbH, in addition to bearing its own costs, to pay those incurred by Xiamen Axent Corporation Ltd and Axent Switzerland AG, in the course of the proceedings before the General Court;

3.    Orders the European Union Intellectual Property Office (EUIPO) to bear its own costs.
