Dismisses the action;

Orders Giand Srl to pay the costs, including those necessarily incurred by Flamagas, SA for the purposes of the proceedings before the Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM).
