The Court:

Annuls Article 1(g) and (h) of Commission Decision C(2009) 428 final of 28 January 2009 relating to a proceeding under Article 81 [EC] and Article 53 of the EEA Agreement (Case COMP/39406 - Marine hoses), in so far as it applies to the period from 13 May 1997 to 21 June 1999;

Dismisses the actions as to the remainder;

Orders each party to bear its own costs.
