Operative part of the judgment

The Court:

Annuls the decision of the First Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM) of 9 July 2013 (Case R 125/2012-1) in so far as it rejected the application for a declaration of invalidity;

Orders OHIM to bear, in addition to its own costs, the costs incurred by Karl-May-Verlag GmbH;

Orders Constantin Film Produktion GmbH to bear its own costs.
