1.    Sets aside the judgment of the European Union Civil Service Tribunal (First Chamber) of 12 May 2011 in Case F-50/09 Missir Mamachi di Lusignano v Commission;

2.    Refers Case F-50/09 to the General Court, acting in exercise of its jurisdiction as a court of first instance, under Articles 268 TFEU and 340 TFEU;

Reserves the costs.
