ORDER OF THE PRESIDENT OF THE FIRST CHAMBER OF THE GENERAL COURT

24 June 2015(1)

(Removal from the register)

In Case T-837/14,

Kemerovskoe OAO ʻAzotʼ, established in Kemerovo (Russia),

OOO Angarskiy Azotno-Tukoviy Zavod (Aatz), established in Angarsk (Russia),

represented by P.V. Schueren, lawyer,

applicants,

v

European Commission,

defendant,

APPLICATION for partial annulment of the Commission Implementing Regulation (EU) No 999/2014 of 23 September 2014 imposing a definitive anti-dumping duty on imports of ammonium nitrate in Russia following an expiry review pursuant to Article 11(2) of Council Regulation (EC) No 1225/2009
(OJ 2014 L 280, p. 19).

1        By letter lodged at the Registry of the General Court on 7 May 2015, the applicants informed the Court, in accordance with Article 99 of the Rules of Procedure, that they wished to discontinue proceedings. They sought no order as to costs.

2        The third subparagraph of Article 87(5) of the Rules of Procedure provides that, where proceedings are discontinued and costs are not applied for, the parties are to bear their own costs. In the present case, since the discontinuance occurred before the application was notified to the defendant and before the defendant was able to incur costs, it suffices to decide that the applicants shall bear their own costs.

3        The case will therefore be removed from the register and the applicants ordered to bear their own costs.

On those grounds,

THE PRESIDENT OF THE FIRST CHAMBER OF THE GENERAL COURT

hereby orders:

1.      Case T-837/14 is removed from the register of the General Court.

2.      The applicants shall bear their own costs.

Luxembourg, 24 June 2015.
