Re:

By his action based on Article 270 TFEU, the applicant seeks, in essence, first, the annulment of the decision of the European Union Intellectual Property Office (EUIPO) of 11 April 2022 adopted to give effect to the judgment of 13 October 2021, IB v EUIPO (T-22/20, EU:T:2021:689) and, in so far as necessary, of the decision of 2 November 2022 rejecting the complaint against the decision of 11 April 2022, second, principally, compensation for the damage suffered as a result of that decision or, in the alternative, that EUIPO be ordered to resume the invalidity procedure and, third, that the third doctor on the Invalidity Committee be appointed ex officio.

Operative part of the judgment

The Court:

Annuls the decision of the European Union Intellectual Property Office (EUIPO) of 11 April 2022 giving effect to the judgment of 13 October 2021, IB v EUIPO (T-22/20);

Orders EUIPO to pay IB the sum of EUR 4 000 in respect of the non-material damage suffered;

Dismisses the action as to the remainder;

Orders EUIPO to bear its own costs and to pay those incurred by IB, and to refund to the Court cashier the sums advanced by way of legal aid.
