The Court:

Annuls the decision of the First Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 4 October 2016 (R 793/2015-1);

Orders EUIPO to pay, in addition to its own costs, those incurred by J-M.-E.V. e hijos, SRL;

Orders Mr Alberto Masi to bear his own costs.
