APPLICATION under Article 263 TFEU for annulment, firstly, of Commission Decision C(2017) 7510 final of 8 November 2017 on state aid SA.48950 (2017/N) implemented by France (OJ 2018 C 20, p. 1), secondly, of Commission Decision C(2017) 7722 final of 20 November 2017, on state aid SA.48907 (2017/N) implemented by France (OJ 2018 C 20, p. 1) and, finally, of Commission Decision C(2017) 7726 final of 20 November 2017, on state aid SA.48699 (2017/N) implemented by France (OJ 2018 C 20, p. 1).
1 By letter lodged at the Court Registry on 15 June 2018, the applicants informed the Court in accordance with Article 125 of the Rules of Procedure of the General Court that they wished to discontinue proceedings and requested that the costs may be decided pursuant to Article 136 of the Rules of Procedure.
2 By letter lodged at the Court Registry on 2 July 2018, the defendant requested that in the order of the General Court to remove the case from the register, the General Court also orders the applicants to pay the costs, in accordance with Articles 125 and 136(1) of the Rules of Procedure.
3 Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.
4 The case shall therefore be removed from the register and the applicants ordered to pay the costs.
On those grounds,
THE PRESIDENT OF THE GENERAL COURT
hereby orders:
1. Case T‑238/18 is removed from the register of the General Court.
2. Netflix International BV and Netflix, Inc. shall pay the costs.
