THE PRESIDENT OF THE SECOND CHAMBER OF THE CIVIL SERVICE TRIBUNAL

makes the following

Order

1        By letter received at the Tribunal Registry on 11 July 2014, Mr D. Possanzini informed the Tribunal that he wished to discontinue his action, the parties having reached an agreement which also covered the costs, under which the parties are to bear their own costs.

2        By letter received at the Tribunal Registry on 22 July 2014, the defendant confirmed that there was an agreement, did not dispute the terms of that agreement as set out by the applicant and informed the Tribunal that it did not wish to make any observations on the discontinuance by the applicant.

3        It is therefore necessary, pursuant to Article 69(2) of the Rules of Procedure, to remove the present case from the register of the Tribunal.

4        Under Article 69(3) of the Rules of Procedure, where there is an agreement between the parties as to costs, the decision made follows that agreement. The costs are therefore to be borne by each of the parties in accordance with the terms of their agreement.

On those grounds,

THE PRESIDENT OF THE SECOND CHAMBER OF THE CIVIL SERVICE TRIBUNAL

hereby orders:

1.      Case F‑124/11 DEP Possanzini v Frontex shall be removed from the register of the Tribunal as a result of the agreement concluded between Mr Daniele Possanzini and the European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union (Frontex).

2.      The parties shall bear their own costs.
