Reference for preliminary ruling

Definition

A reference for a preliminary ruling is when a national court asks the Court of Justice of the EU questions on how to interpret EU law or if EU legislation is valid.
The Court answers these questions, which helps the national judge to apply EU law correctly and consistently. The Court’s ruling is “preliminary” because it doesn’t decide the case – the national judge makes the final decision on the case, applying EU law as interpreted by the Court.
