Let’s take a close look at the infringement procedure, the mechanism that ensures all Member States comply with EU law in the same way. When a country fails to fulfil its obligations – whether in relation to environmental protection, citizens’ rights or any other area – the European Commission, as the guardian of the Treaties, can launch infringement proceedings. If the country still fails to comply, the case may be referred to the Court of Justice of the European Union.
