Hearing: Case C-661/24 Académie Fiscale and Others
On Tuesday 14 April 2026, the Court of Justice will hear case C-661/24 Académie Fiscale and Others.
This case concerns a new law in Belgium requiring operators of electronic communications services to retain traffic and location data, in order to prevent fraud and malicious use of networks and to ensure security. Several professional organisations, fundamental rights associations and individuals are arguing that this law leads to the overly broad retention of communications data, which would undermine the rights to privacy and the protection of personal data.
The Belgian Constitutional Court has asked the Court of Justice whether national legislation can require operators to retain certain communications data from all users, for a limited period, in order to prevent fraud and abuse on their networks.
