Hearing: Case C-524/24 Italy v Austria
On Tuesday 21 April 2026, the Court of Justice will hear case C-524/24 Italy v Austria.
This case has been brought by Italy against Austria over four measures – a night traffic ban, a sectoral traffic ban, a winter traffic ban and traffic restrictions through “dosing” – introduced in Tyrol to limit lorry traffic on the Inn Valley and Brenner motorways.
Italy argues that these measures infringe the free movement of goods within the EU and that, despite two judgments of the Court of Justice in 2005 and 2011 (see press releases No 97/05 and No 138/11), Austria has maintained unlawful restrictions on the free movement of goods and introduced additional measures.
