Hearing: Case C-469/25 Henssen

On Tuesday 29 September 2026, the Court of Justice of the European Union will hear Case C-469/25 Henssen.

This case concerns a British national who was refused entry into the Schengen area when Dutch authorities flagged him in the Schengen Information System (SIS). They argued that his arrival in the Netherlands posed a threat to public order. The British national is challenging that decision.

The Dutch Council of State has asked the Court of Justice about the EU rules that govern when Member States can enter an alert in the SIS concerning a foreign national in order to refuse entry and stay. In particular, it asks about alerts based on a potential threat to public order and the discretion of national authorities.
