Order: Case C-460/26 R Poland v Council

On Tuesday 29 September 2026, the Vice-President of the Court of Justice issued an order in Case C-460/26 R Poland v Council.

In this case, the Court is examining the Council’s decision authorising the provisional application of the EU-Mercosur interim trade agreement.

Negotiations between the EU and Mercosur have resulted in two parallel legal instruments:

• a comprehensive partnership agreement combining political dialogue, cooperation and trade
• an interim trade agreement, focusing primarily on the liberalisation of trade and investment, which has been provisionally applied since 1 May 2026

Poland considers that the Council’s decision authorising the provisional application of the interim trade agreement is unlawful and has therefore asked the Court of Justice to annul it. However, pending the Court’s ruling on its action, Poland has also requested that the implementation of that decision be suspended.
