Hearing: Case C-474/25 Medienanstalt Berlin-Brandenburg
A German media regulator held that, under German law, a provider of an audio streaming service established elsewhere in the EU was required to make certain transparency information easily perceptible, directly accessible and constantly available on its apps. The provider challenged that requirement, arguing that it breaches the “country-of-origin” principle under the e-Commerce Directive and is incompatible with the Digital Services Act.
A German court has asked the Court of Justice whether the e-Commerce Directive and the Digital Services Act preclude national rules that require providers of media intermediary services established in another Member State to make certain transparency information accessible on their apps.
